1. Service Description

Business Name: Focus Guardian (operated by GAISM LLC)

Services Offered: Focus Guardian provides an AI-powered productivity platform that helps users:

• Manage focus sessions and track productive time
• Triage and prioritize email communications using AI
• Generate weekly productivity reports and insights
• Receive AI-powered coaching suggestions
• Integrate with Gmail for seamless email management
• Sync data across devices with cloud storage

2. Subscription Plans

Free Plan: Basic focus tracking and session management with local storage

Pro Plan ($12/month): Unlimited focus sessions, AI email triage, personalized coaching, weekly reports, cloud sync, Gmail integration, priority support

Enterprise Plan ($49/month): All Pro features plus team collaboration, advanced analytics, custom integrations, dedicated account manager, SSO support

3. Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refunds are provided for partial months of service
• Your subscription will not auto-renew after cancellation
• Your data will be retained for 30 days, after which it may be permanently deleted

4. Refund Policy

We offer a 7-day money-back guarantee for new subscribers:

• Request a refund within 7 days of your initial subscription for a full refund
• Contact our support team at billing@gaism.com
• Refunds are processed within 5-10 business days
• Refunds after the 7-day period are considered on a case-by-case basis for extraordinary circumstances

5. Dispute Resolution

If you have a billing dispute or service issue:

1. Contact our support team first at support@gaism.com
2. We will work with you to resolve the issue within 5 business days
3. If unresolved, disputes will be handled through Stripe's dispute resolution procedures
4. For legal disputes, both parties agree to attempt mediation before litigation

6. User Obligations

By using Focus Guardian, you agree to:

• Provide accurate and truthful information during registration
• Maintain the security and confidentiality of your account credentials
• Use the service in compliance with all applicable laws and regulations
• Not share your account with others or allow unauthorized access
• Not use the service for illegal activities or to harm others
• Accept responsibility for all activity under your account

7. Data and Privacy

We take your privacy seriously. Please review our Privacy Policy for details on:

• What data we collect (focus sessions, email metadata, usage statistics)
• How we use your data (personalization, analytics, AI coaching)
• How we protect your data (encryption, secure storage, access controls)
• Your data rights (access, deletion, export, correction)

AI Processing: We use Google's Gemini AI for email triage and coaching. Your data is processed but not used to train AI models. Email content is analyzed in real-time and not permanently stored by the AI service.

8. Service Modifications

GAISM LLC reserves the right to:

• Modify features, add new features, or discontinue features with 30 days' notice
• Change pricing for new subscribers immediately; existing subscribers receive 30 days' notice
• Suspend service temporarily for maintenance (with advance notice when possible)
• Update these Terms of Service (we will notify you of significant changes)

Price changes will not affect your current billing cycle. You may cancel before the next billing cycle if you disagree with price changes.

9. Intellectual Property

All content, features, and functionality of Focus Guardian, including but not limited to software, text, graphics, logos, and AI models, are owned by GAISM LLC and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of your data (focus sessions, preferences, etc.). By using our service, you grant us a license to process and store your data solely to provide the service.

10. Limitation of Liability

Focus Guardian is provided "as is" without warranties of any kind, express or implied. GAISM LLC shall not be liable for:

• Indirect, incidental, or consequential damages arising from service use
• Loss of data, profits, or business opportunities
• Service interruptions or errors
• Third-party integrations (Gmail, Firebase, etc.) failures

Our total liability to you for any claims shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Termination

We may terminate or suspend your account immediately if:

• You violate these Terms of Service
• You engage in fraudulent activity
• Your payment method fails repeatedly
• You abuse or harass our support team

Upon termination, your right to use the service ceases immediately. We may retain your data for legal compliance purposes.

12. Governing Law

These Terms shall be governed by the laws of the State of Louisiana, United States, without regard to conflict of law principles. Any legal action must be brought in the courts of Louisiana.
